Preamble

We, the members of this party, coming together as equal citizens of India, adopt this Constitution to bind ourselves to a single standard of conduct. We hold that people are not vote banks, but the reason government exists. We ask to be judged not by what we say about ourselves, but by the records this Constitution requires us to keep and publish. We accept that power exercised without limits corrupts the person who holds it and the organisation that permits it, and we therefore place limits on ourselves before we ask for any from anyone else.

1. Preamble

We, the members of this party, coming together as equal citizens of India, adopt this Constitution to bind ourselves to a single standard of conduct. We hold that people are not vote banks, but the reason government exists. We ask to be judged not by what we say about ourselves, but by the records this Constitution requires us to keep and publish. We accept that power exercised without limits corrupts the person who holds it and the organisation that permits it, and we therefore place limits on ourselves before we ask for any from anyone else.

2. Name

The working name of the party is the People's Governance Party. This name is provisional. It has not been checked against the register of political parties maintained by the Election Commission of India, nor against trademarks or the names of existing State parties, and no claim of availability, registration or exclusivity is made. The name may change following that verification, and any change will be published with its reason.

3. Objectives

The objectives of the party are: to serve citizens without discrimination; to identify public problems accurately and work on practical solutions; to develop leadership through demonstrated public service; to maintain complete transparency in the party's own finances and decisions; to participate in democratic processes peacefully and lawfully; to hold itself publicly accountable for what it promises; and to use technology, including artificial intelligence, to serve citizens while keeping every consequential decision with a person.

4. Commitment to the Constitution of India

The party bears true faith and allegiance to the Constitution of India as by law established. The party upholds the sovereignty, unity and integrity of India. The party upholds the principles of socialism, secularism and democracy. The party is committed to peaceful and lawful democratic participation and to non-violence.

It must be reproduced exactly, and inserted only after confirmation by qualified legal counsel against the current statutory text and Election Commission of India requirements. Until then this section is incomplete, and the party makes no claim to be registrable in its present form.

5. Membership

Membership is open to any citizen of India who has attained the age of eighteen years, who accepts this Constitution, and who is not a member of another political party. An applicant must make a declaration to that effect. Membership is not conditional on payment beyond any nominal subscription the party may set, and inability to pay shall never be a bar to membership.

6. Equality and non-discrimination

No person shall be denied membership, office, opportunity or fair treatment within the party on grounds of religion, caste, community, race, sex, gender, language, region, place of birth, disability, or economic status. The party shall not maintain records of the religion or caste of members or citizens, and shall not categorise, target or address people on those grounds. The absence of such fields from the party's systems is itself a protection, and their introduction would require an amendment to this Constitution.

Enforced by: No religion or caste field exists in the data model. There is nothing to query.

7. Rights of members

Every member has the right: to participate in party processes open to their level of membership; to stand for internal office subject to the eligibility conditions of this Constitution; to see the reasons for any decision affecting them; to see the full basis of any performance assessment made of them; to appeal any decision affecting them; to raise a concern in good faith without retaliation; to access, correct and obtain a copy of their personal data held by the party; and to resign at any time without penalty.

8. Responsibilities of members

Every member shall: uphold the Constitution of India and this Constitution; conduct themselves peacefully and lawfully; treat every citizen and every fellow member with respect; refrain from hate speech, communal or caste-based appeals, and personal abuse of political opponents; declare conflicts of interest; not misuse party position for personal gain; and not misrepresent the party's positions.

9. Party organs

The organs of the party are the National body, State and Union Territory bodies, District bodies, Parliamentary Constituency bodies, Assembly Constituency bodies, and Local bodies, together with functional teams established for defined areas of work. Every organ has a defined scope, a defined membership and an identifiable reporting relationship. No organ, and no office within one, has undefined authority.

10. National structure

The National body is responsible for the party's national positions, its Constitution, its finances, its legal compliance and its overall organisation. It comprises office bearers holding defined portfolios, each with a published term. No national office confers authority over an individual citizen's private data or over the individual donor records of the party.

11. State and Union Territory structure

Each State and Union Territory in which the party operates shall have a body responsible for party work within that unit, accountable to the National body and to the members within that unit. Where a Union Territory has no Legislative Assembly, the party shall not create structures that imply one exists.

Enforced by: Geography model records whether a unit has a legislature; assembly structures cannot be created beneath one that does not.

12. District structure

Each district in which the party operates shall have a body responsible for coordination across the constituencies within it, and for supporting volunteers working in them.

13. Parliamentary Constituency structure

Each Parliamentary Constituency in which the party operates shall have a coordinating body, whose boundaries follow the constituency boundaries published by the Election Commission of India and recorded in the party's verified geography dataset.

Enforced by: Constituency boundaries come from a versioned, verified geography dataset; they are never entered by hand.

14. Assembly Constituency structure

Each Assembly Constituency in which the party operates shall have a Constituency Coordinator and such area and local coordinators as the volume of work requires. This is the primary operating unit of the party.

15. Local structure

Below the Assembly Constituency, the party shall organise by ward, village or locality as appropriate to the area, using official local government units wherever authoritative data for them exists.

16. Volunteer structure

Volunteers are organised under Local Coordinators, who report to Area Coordinators, who report to the Constituency Coordinator. Every volunteer shall know who they report to, what is expected of them, and how their contribution is assessed. No volunteer shall be assigned work beyond the availability they have themselves declared.

Enforced by: Reporting relationship is a required field. Workload controls use declared availability.

17. Internal democracy

The party shall conduct its internal affairs democratically. Members shall be consulted on matters affecting them. Consultations, opinion polls and binding internal votes are distinct instruments and shall always be described accurately: an opinion poll shall never be presented as an election, and a consultation shall never be presented as binding.

Enforced by: Poll types are distinct in the data model, and each renders a mandatory, type-specific disclaimer.

18. Organisational elections

Official organisational elections shall be held for such offices and at such intervals as this Constitution provides. Each shall have a defined electoral roll, a defined nomination process, an auditable record, and independent review. The audit record of an organisational election shall be tamper-evident and available to the independent reviewer in full.

Enforced by: Poll audit trail is an append-only hash chain; organisational elections require independent review by construction.

19. Leadership eligibility

Eligibility for internal leadership shall be assessed on demonstrated service, integrity, capability and compliance with this Constitution. Wealth, family connection, celebrity, social media following, or personal proximity to any office bearer shall confer no eligibility whatsoever. There shall be no maximum age for internal leadership; capability and service are the tests. Eligibility to contest a public election is a separate question governed entirely by applicable law.

20. Leadership terms

Every leadership position shall have a defined term. Every term shall have a recorded start date, a scheduled end date, and an actual end date. Term history for leadership positions shall be public.

21. Two-term rule

No person shall hold the same leadership position for more than two terms. For this purpose: a partial term served for more than half its length counts as a full term; three acting terms count as one term; and an interim appointment lasting more than six months counts as a full term.

A position renamed, restructured or re-described remains the same position for the purpose of this rule where its level, scope and function are unchanged. Term counting is performed on a position equivalence key rather than on the position's title, so that renaming a post cannot reset anyone's count. Any proposal to create a position that is materially equivalent to an existing one shall be flagged for review before it is created.

Enforced by: term-limits.ts, counted on equivalenceKey, with evasion detection on position creation. Covered by tests.

22. Removal from leadership

A person may be removed from a leadership position for breach of this Constitution, for conduct bringing the party into disrepute, or for sustained failure to perform the duties of the office. Removal requires the approval of three authorised persons, none of whom may be the person who proposed the removal. The person facing removal shall be told the grounds, shall be heard, and may appeal.

23. Candidate selection

Selection of candidates for public election shall follow a defined process combining service record, citizen feedback, integrity review and legal eligibility. A high performance score creates eligibility for consideration only. No process shall automatically select the highest-scoring person, because any such rule can be gamed, and a party that can be gamed will be. Final selection is a human decision requiring party and legal approval together.

Enforced by: Candidate module is disabled by compliance gate; selection requires a three-approver request including legal sign-off.

24. People's Voice

The party shall maintain permanent means for citizens and members to express their priorities and opinions, and shall publish the results including those that are unfavourable to the party's existing positions. Where the party does not follow a consultation result, it shall publish its reasons.

25. Discipline

Breaches of this Constitution may result in counselling, warning, suspension of office, suspension of membership or expulsion, proportionate to the breach. No disciplinary action shall be taken without the person being informed of the allegation and given an opportunity to respond. No automated system shall determine a disciplinary outcome.

Enforced by: AI is prohibited from final disciplinary decisions; the prohibition is enforced at runtime, not merely stated.

26. Grievance system

Any member, volunteer or citizen may raise a grievance about the conduct of the party or any of its members. Grievances shall be acknowledged, tracked, and answered. A person raising a grievance in good faith shall not be penalised, and any retaliation is itself a disciplinary matter.

Enforced by: Content reports carry a good-faith protection flag set by default.

27. Appeals

Any decision affecting a member or volunteer may be appealed to a level above the one that made it. An appeal shall receive a reasoned answer in plain language. Where an appeal succeeds, the original record shall be corrected and the correction shall be visible rather than silent.

28. Finance

The party shall maintain complete accounting records. Every receipt and every expenditure shall be recorded with its date, category, purpose and supporting evidence. Public transparency reporting is additional to, and never a substitute for, statutory accounting obligations.

29. Donations

The party shall accept contributions only through lawful means and only where the donor's identity is recorded as the law requires. The party shall not operate any workflow designed to obscure the source of a contribution. Donor identity shall not be published unless the law requires it or the donor has expressly and revocably consented.

Enforced by: Donor records are encrypted; publication requires an explicit consent flag; fundraising is blocked pending compliance review.

30. Audits

The party's accounts shall be audited. The auditor shall have unrestricted read access to financial records and to the audit trail, and shall be able to verify its integrity independently. The auditor shall hold no power to alter any record.

Enforced by: AUDITOR role is read-and-verify only, with no write permission of any kind.

31. Transparency

The party shall publish its receipts and expenditure by category, its commitments and their status including failures, its leadership term history, its constitution and manifesto with full version history, and the data quality of the datasets it relies on. Historical versions of public documents shall never be silently replaced.

Enforced by: Versioned content models; superseded versions retained and publicly readable.

32. Data protection

The party shall collect only the personal data it needs, for stated purposes, with recorded consent, and shall retain it only as long as necessary. Identifying data shall be encrypted at rest. Home addresses, private contact details and complaint contents shall never be published. Members may access, correct, export and request deletion of their data, subject to records the party is legally required to retain, and shall be told exactly what was retained and why.

33. Governance of artificial intelligence

Artificial intelligence may assist the party by classifying, summarising, detecting duplicates and patterns, and drawing attention to matters that need human attention. It shall never, by itself: appoint or remove a leader, select a candidate, determine guilt, disqualify any person, decide a disciplinary outcome, remove a vote, close a citizen's issue, or publish content.

Every AI output shall record the model and prompt version that produced it, a description of its input, its confidence and its reasoning. Every high-risk output shall require a recorded human review before it has any effect. The party shall publish how often human reviewers disagreed with the recommendation, because a disagreement rate near zero would show that the review is not real.

Enforced by: ai.ts refuses at runtime to record an output asserting a prohibited action; high-risk outputs are gated on a recorded human review.

34. Non-violence

The party is committed to non-violence. No member shall promote, threaten, organise or excuse violence, damage to public or private property, or intimidation, in the party's name or otherwise in political activity. Breach of this provision is grounds for expulsion.

35. Peaceful democratic participation

All party activity shall be peaceful and lawful. Any public gathering organised by the party shall have a stated purpose, a named responsible organiser, the required permissions obtained in advance, a safety plan, an emergency contact and published conduct rules. No gathering shall be publicised by the party until these are in place. The party shall not obstruct emergency services, essential public services, or the movement of people going about their lawful business.

Enforced by: Gathering event types cannot be published without a completed compliance checklist and legal review.

36. Equality of participation

The party shall organise so that participation does not require a person to sacrifice their livelihood, education or family responsibilities. Online participation shall be a first-class route to contribution and to advancement, not a lesser one.

37. Religious neutrality

The party shall not appeal for support on religious grounds, shall not maintain records of the religious affiliation of citizens or members, and shall not organise its work around religious identity. Every citizen is equally entitled to the party's service regardless of faith or absence of faith. Where a matter of public policy touches religious practice, the party shall address it as a question of law and public interest.

38. Anti-hate principles

No member shall use, endorse or circulate content that attacks or demeans any person or community on grounds of religion, caste, region, language, ethnicity, sex, gender or disability. Criticism of a policy, a government or a political party is legitimate democratic activity. Abuse, threats and hatred directed at people are not, and are grounds for expulsion.

Enforced by: Moderation workflow with concern categories; hate, threat and violent content escalate to legal review and cannot auto-publish.

39. Student protection

Education comes first. The party shall not ask students to miss classes or examinations, abandon their studies, or attend gatherings to provide numbers. Student members shall be offered online, research, technology, policy and civic education roles. Student volunteer workload shall be capped and shall pause during examination periods.

Enforced by: Volunteer profiles carry a student flag with study protection enabled by default, defaulting to online-only roles.

40. Volunteer protection

Volunteers shall receive a clear role description, training appropriate to their work, a stated reporting line, and workload within their declared availability. Volunteers shall never be asked to take custody of a citizen's original documents or money. A volunteer may raise a concern, decline a task, take a break or leave without penalty or hostility. The party shall not treat volunteers as expendable.

41. Conflict of interest

Any member with a personal, financial or family interest in a matter before the party shall declare it and shall take no part in the decision. Undeclared conflicts are a disciplinary matter.

42. Code of conduct

Every member and volunteer shall accept a code of conduct covering respectful behaviour, non-discrimination, non-violence, honesty in public statements, protection of personal data, refusal of any inducement, and prohibition of harassment of any kind. Acceptance shall be recorded and shall be renewed when the code changes.

43. Amendment

This Constitution may be amended by a defined process requiring publication of the proposed amendment, a period for member comment, legal review, and the approval of three authorised persons, none of whom proposed it. Every version of this Constitution shall be retained and remain publicly readable. An amendment that removes an accountability provision shall state plainly, in the change summary, that this is what it does.

44. Merger

The party shall not merge with another organisation without member consultation, publication of the terms, legal review, and the approval process required for a constitutional amendment.

45. Split

In the event of a division within the party, the party's records, finances and obligations shall be dealt with lawfully and transparently, and members shall be informed of their position. No faction shall claim the party's assets or name without lawful entitlement.

46. Dissolution

On dissolution, the party's assets shall be dealt with as the law requires. Citizen data held by the party shall be deleted or transferred only as the law permits, and every citizen whose data is affected shall be informed.

47. Legal compliance

The party shall comply with applicable law. Where a party activity is legally sensitive, it shall not proceed until it has passed a recorded compliance review. The party makes no claim that its systems make it legally compliant; compliance requires review by qualified Indian legal professionals and adherence to current Election Commission and government requirements.

48. Other provisions

Where this Constitution is silent, the party shall act consistently with its objectives, with the Constitution of India, and with the principle that the party exists to serve citizens rather than the people who lead it. Any gap identified in this Constitution shall be published and addressed by amendment rather than by informal practice.
